Terms and Conditions for Sixth Sense Group LLC

1. Introduction

This Agreement sets forth the terms under which Sixth Sense Group LLC (“Company”) provides its services and products to users (“User”), who may access offerings through various digital platforms or direct contact.

2. Brands

The Company operates under the following brands:

• Sixth Sense (sixthsense.energy, sixthsense.yoga)
• Positive Vibration (positivevibration.com)

3. User Categories

• Direct User: May reschedule once; eligible for a full refund after a second session if no energy is experienced.
• Guest User: Receives a 10% discount with a Representative's code; any refunds are processed to the purchasing Direct User.
• Representative User: Earns a 25% commission per successful Activation, paid via PayPal.
• Other User Types: (Ambassador, Organization User, etc.) – terms unchanged from previous versions.

4. Products, Services, Pricing, and Conditions

4.1. Service Table

4.1.1. Key Notes

• Refunds for Activation are available if the user does not experience the described energy effects, minus a 5.5% PayPal fee. Cryptocurrency payments are nonrefundable.
• Preview, Preview Pack, Channel Harmonization, and PsyChi subscriptions are nonrefundable.
• Representatives earn a 25% commission per successful Activation purchased with their code, paid via PayPal.
• Guest Users receive a 10% discount with a Representative's code; refunds are processed to the purchasing Direct User.
• Gifted Preview Packs never expire but are nonrefundable.
• The "Second Attempt Free" applies only to Activation, not to Preview or other services.

4.2. Service Descriptions

Preview

A short introductory session designed to provide users with initial exposure to the Company's energy practices.
Price: $1 per session (special offer, 33 seconds) or $11 standard.
Refund Policy: Nonrefundable.

Activation

A comprehensive session aimed at establishing a lasting connection to the Company's energy modalities.
Price: $99 per session.
Refund Policy: Refundable (minus a 5.5% PayPal fee, resulting in $93.56 returned) if the user does not experience the described energy effects. Payments made in cryptocurrency are nonrefundable.

6 Preview Pack

A package allowing a user to gift six individual Preview sessions.
Price: $5 for six sessions.
Refund Policy: Nonrefundable. Gifted sessions never expire.

Channel Harmonization

A session focused on emotional healing and energetic balance.
Price: $11 per session (requires Preview and Activation).
Refund Policy: Nonrefundable.

PsyChi: AI Therapist

Ongoing digital mental wellness support via AI-powered tools.
Price: $22 per month.
Refund Policy: Follows standard subscription cancellation practices; nonrefundable for the current billing period.

5. Payment and Refunds

• 5.1. All payments made via cryptocurrency are strictly non refundable.
• 5.2. Refunds for eligible services processed through PayPal will deduct a 5.5% fee.
• 5.3. Gifted products are refundable only if the recipient does not experience the intended energy effect.
• 5.4. No refunds are provided for Preview sessions, 6 Guest Preview Packs, Channel Harmonization, or for subscription periods already commenced for PsyChi: AI Therapist.
• 5.5. PayPal Account Linking:
  We provide a button feature that allows you to link your PayPal account to Sixth Sense. This functionality is used solely for the purpose of paying commissions earned by eligible users (such as Representatives). Your PayPal account information will not be used for any other purpose.

6. Health and Liability

The Company's services are intended for personal development and wellness. They do not constitute medical advice or treatment. Users participate at their own risk, and the Company does not guarantee specific outcomes

7. Intellectual Property

All materials, including but not limited to videos, text, and graphics, are the exclusive property of the Company and are provided for personal use only. Unauthorized distribution or reproduction is prohibited. Any content uploaded by the user, including but not limited to testimonials, may be used by the Company for advertising or promotional purposes.

8. Governing Law

This Agreement is governed by the laws of Nevis. Any disputes will be resolved through arbitration at the Nevis International Arbitration Centre under UNCITRAL Rules.

9. User Consent for Contact Access and Referrals

9.1 Contact Access Authorization

Upon logging in and after successfully concluding the Activation, the User is presented with the option to grant Sixth Sense access to all contacts stored in their Google account. Granting such access is entirely voluntary and subject to the User's explicit consent.

9.2. Referral and Communication on User's Behalf

If the User grants access as described above, Sixth Sense may, on behalf of the User, send email invitations or offers to all of the User's contacts. These communications will offer the recipient a free Preview session and will clearly indicate that the invitation is sent on behalf of the User. Sixth Sense will not use the contacts for any other purpose without additional consent and will process all contact information in accordance with its Privacy Policy.

9.3. User Responsibility and Revocation

The User is responsible for ensuring that they have the right to share their contacts with Sixth Sense. The User may revoke this access at any time through their account settings or by contacting privacy@sixthsense.energy. Upon revocation, Sixth Sense will cease sending communications to the User's contacts and will delete any contact information obtained, except as required to comply with applicable law.

This update makes it explicit that, with consent, Sixth Sense will access all contacts in the user's Google account.
